What Is Chapter 13 Bankruptcy?
Individuals who have regular income, unsecured debt less than $383,175, and secured debt less than $1,149,525 are eligible for a repayment plan under Chapter 13. In Chapter 13, debtors keep their property and make regular payments to the trustee in order to repay creditors over the life of the plan, which is between three to five years. Debts may be repaid in full, repaid in part, or not repaid at all.
Chapter 13 is most commonly used for the following:
- Preventing a house foreclosure
- Making up missed car payments
- Making up missed mortgage payments
- Paying back taxes
- Stopping interest from accruing on your tax debt
- Keeping valuable, non-exempt property
Depending on the type of debt, some debts must be paid with interest. Repayment will vary based on the debtor's income and the composition of the debt. Additionally, certain debts may be discharged in Chapter 13 that can't be discharged in Chapter 7. We can review these in a free consultation.
